Terms of Trade Agreement in Force
A Terms of Trade Agreement was reached recently on behalf of the
English-language Canadian independent production community by CRC's founder,
the Canadian Media Production Association (CMPA), with the 5 major private
broadcast groups Astral, Bell Media, Corus Entertainment, Rogers Broadcasting
and Shaw Media (Broadcasters).
There are many important provisions to the Agreement but those pertaining to
retransmission royalties are of primary concern to CRC and the producers we
represent and they confirm the following: When licensing audiovisual works,
Broadcasters cannot obtain an assignment of retransmission royalties or
acquire retransmission rights (both Canadian-territory and internationally)
on any productions produced by English-language Canadian independent television
producers (Independent Producers).

International Standard Audiovisual Number (ISAN)
ISAN provides a standardized lexicon for rightsholders and users
– a way to immediately and accurately identify a work. The
standard was approved and published by the International Organization
for Standardization (ISO) in 2002. Part two of the standard governing
how versions (such as languages) will be identified was approved
by all ISO member countries in March, 2006.
This ends a nine-year process that involved industry experts from
around the world (including producers, rightsholder groups, and
distributors), and represents a breakthrough in the administration
of film rights, permissions, and payments – ISAN promises
to vastly improve both identification and tracking of audiovisual
works.
The CRC contributed to ISAN through the participation of our President,
who served as a member of the ISO Working Group. As implementation
begins worldwide, the CRC is evaluating how to implement ISAN in
Canada.
The International ISAN agency is based in Geneva, and regional agencies
are opening around the world.

Producers Audiovisual
Collective of Canada (PACC)
This sister collective – established by the CMPA on behalf
of Canadian producers – collects and distributes royalties
deriving from blank audiovisual media (often referred to as ‘blank
tape levies’), from the rental and lending of video
recordings, from exhibition or public performance rights, and, from
educational copying and performance. PACC, a separate organization with
a distinct mandate, shares management and office space with the CRC.
